【禁闻】专家:周案公审会出现什么局面?

【新唐人2014年09月04日讯】据大陆媒体披露,对前中共常委周永康案的处理,目前已经进展到开始准备公审材料。法学专家指出,这一消息说明,周永康等案件已经进入司法程序,而对周永康的公审,不亚于当年公审“四人帮”。

《时代周报》9月1号的文章“反腐生产力”,2号经过《人民网》,《央视》引用后,被国内多家媒体转载。不过,《时代周报》自己,2号却删除了这篇文章。

这种情况,近期并不少见,往往都出在官方试图透露一些什么消息的时候。仔细比较一下,《人民网》和《央视》都把文章标题换成了“能源系贪官涉案总金额或高达数千亿”。不过,国内其他一些媒体则更直接,干脆捅破窗户纸,直接在标题上就说:“消息称周永康涉案金额正核定,公审材料开始准备”

显然,这才是《时代周报》4000多字的那篇原文里,最具含金量的一句话。原文是这么写的:“据最新消息称,周永康的涉案金额尚在核定当中,但公审需要的材料已开始准备。”

东南大学法学教授张赞宁:“提到了公审也就到了司法侦查阶段,如果还是在党的纪律检查委员会,还是双规的情况下,就不会讲公审。这是我们国内目前最大的一个案子,它的意义可能不亚于对‘四人帮’的审判。”

官媒《新华网》在7月29号报导,周永康“严重违纪”,中纪委对其立案审查。不过,在这则不到100字的简短报导里,只提到周永康涉嫌严重“违纪”,却没提“违法”。

立案审查后,无论是海内外,舆论都很关心一个问题,那就是“周永康是不是句号”?

在8月25号全国政协常委会上,当被问到打完周永康这只“大老虎”,还有没有更大老虎时,王岐山笑着说“以后你就慢慢懂”。

而海外多家中文媒体,也报导了从王立军,薄熙来,到周永康,这条线延伸下去,习近平最终“剑指江泽民”。有消息说,江泽民一再阻扰习近平对周永康的处理,据香港“动向”杂志报导,习近平上台后遭遇过6次暗杀。

目前在习近平“老虎苍蝇一起打”的反腐运动中,落马的省部级高官达40多位。周永康案“拔出萝卜带出泥”,仅他早年经营的中石油系统,就多达十几名高官落马,而他盘踞的政法委、公安部、以及有裙带关系的国资委、海南省、四川省等部委和地方有近30位官员落马。

《亚洲新闻周刊》总监黄金秋:“中央为了对付这种反抗,对他们贪腐的这种罪名也要进行分化,最后一步一步的把外围全部打掉,把保守的壁垒全部攻下。”

目前“反腐”与“改革”,已成了新一届中共领导集体新政以来,出现频度最高的两大关键词,当局称,“反腐”为“改革”清除障碍的逻辑已经明确。

旅美时政评论员蓝述:“从目前报导的材料来看,它还是只把周永康的罪行的司法程序局限在‘贪污’和‘受贿’上。周永康手上沾满了血债,这个血债它不去审理,人命关天的事情,它不去审理。它这个反腐的目的,仍然是保护它这个体制,这样的反腐和改革是没有出路的。”

《北京之春》主编胡平指出,如果在公审时,周永康拒绝配合,或万一不惜鱼死网破,反咬一口,那就更不堪设想了。

Chinese Media: Materials for An Open Trial of Zhou Yongkang
Now In Preparation

A Chinese media report said the Chinese Communist Party
(CCP) is now preparing for an open trial of Zhou Yongkang.

A legal scholar commented that Zhou’s case is finally
put into judicial practice.

An open trial of Zhou can be equally important as that
of the “Gang of Four".

On September 1, Time Weekly published an article titled
“Productivity of Anit-corruption".

The next day, the article was forwarded first by CCTV and
People’s Daily websites and then by most Chinese media.

However, Time Weekly removed the article
from its website on September 2.

This is not unusual. Similar stories were seen especially
when the CCP tried to reveal some news to the public.

In comparison, both People’s Daily and CCTV websites used
a new title to forward the article:

“Corrupt Officials of Energy Sector May Have Embezzled
Hundreds of Billions".

Some other Chinese media reported the story more
directly, as they used the following title:

“Sources Said an Open Trial of Zhou Yongkang Is in
Preparation: Materials Verification Are in Progress."

Obviously, this is the real key information in the 4,000-word
Time Weekly’s article.

The original text is “According to a latest report, the amount
of money involved in Zhou’s case is under verification and
materials for an open trial is also under preparation."

Zhang Zanning, law professor at Southeast University, “the
term “open trial" suggests the stage of judicial investigation.

We won’t say “open trial" if the case is still at the hands
of the party’s Discipline Inspection Commission.

This is currently the most important case in China. Probably
it is equally as important to that of the “Gang of Four"."

The Xinhua News Agency reported on July 29 that, Zhou
Yongkang had committed “serious discipline violations",
and was being investigated by the Central Discipline
Inspection Commission.

However, the less-than-100-word briefing only mentioned
“discipline violation", but not “breach of law".

After the investigation of Zhou was announced, all Chinese
and foreign media are asking the same question:

Is Zhou Yongkang the end of the story?

In the meeting of Consultative Conference Standing
Committee on August 25, someone asked whether there
are any “bigger tigers" behind Zhou Yongkang.

Wang Qishan said with a smile “You will know
the answer step by step."

Multiple overseas Chinese media said, from Wang Lijun,
Bo Xilai to Zhou Yongkang, Xi Jinping’s campaign would
finally “extend to Jiang Zemin". Sources said Jiang had
repeatedly attempted to stop Xi’s campaign against Zhou.

The Trends magazine said Xi had been assassinated
six times after taking power.

In Xi’s campaign against “both tigers and flies", over 40
provincial-level or higher officials had fallen.

Just in the energy sector, which was ruled by Zhou in earlier
times, over a dozen high officials had been investigated.

About 30 officials were dismissed in other places closely
related to Zhou, including the Politics and Law system,
Ministry for Public Security, the SASAC, and provincial
governments of Hainan and Sichuan.

Huang Jinqiu, director of Asian Newsweek, “the current CCP
leaders polarized any people on corruption charges.
This is to reduce resistance.

Finally they plan to destroy all protection outer-rings
of the target group."

“Anti-corruption" and “reform" are the most frequently
used words after the new CCP leader group came to power.

The CCP officially said it is very clear that “anti-corruption"
serves to clear the way for “reform".

Lan Shu, potlicial commentator, “from all those reports, the
CCP said nothing more than bribery or embezzlement when
talking about Zhou’s crimes.

Zhou has bloody debts, as he murdered numerous people.
However, the CCP has never mentioned all those crimes.

The goal of its anti-corruption campaign and reform is still
to protect its regime, and so will never succeed."

Hu Ping, editor-in-chief of Beijing Spring magazine,
said if Zhou refuses to cooperate or even makes
desperate moves in the open trial, the consequences
can be unimaginable.
