【禁闻】判刘志军死缓 最终成全了谁?

【新唐人2013年07月10日讯】被查了两年多、涉及400多个案例、牵扯数亿人民币的正部级贪官、前铁道部部长刘志军,7月8号终于被中共法院一审宣判“死缓”,消息一出,引起哗然﹕“死缓”似乎成了贪官的免死金牌。但,为何贪官无死刑?刘志军身后的保护伞到底是谁﹖成为舆论的焦点。有分析指出,刘志军被判死缓,其实是成全了中共贪官,也就是成全了中共。

中共原铁道部部长刘志军受贿、滥用职权一案,8号在北京市第二中级法院一审宣判。法院宣称,刘志军曾经为11个人在职务晋升、承揽工程、获取铁路货物运输计划等方面提供了帮助,涉及收受财物6,460多万元。最后法院以受贿罪、滥用职权罪等数罪并罚,决定判处刘志军死刑,缓期二年执行。

从刘志军被拿下到判决,经过了一年多,但雷声大、雨点小,网民再三质疑这背后是否存在政治上的交易。

时事评论员林子旭分析,中共体制下无官不贪,刘志军被判死缓,应该是中共官员的希望。

时事评论员林子旭:“刘志军被判死缓,其实是成全了所有的这些中共的贪官,因为刘志军要判死刑的话,那后面的贪官,比刘志军贪得更多的贪官,他们也肯定要判死刑。”

时事评论员任百鸣也表示,很多贪官紧绷的神经舒缓了很多。

时事评论员任百鸣:“因为外界一致认为,刘是难逃一死的,结果突然是一个大的翻转,死缓开了一个小口子,这样一下就大大的舒缓了整个中共官场这种紧绷的神经,因为大部分也都是贪官了,他们也是参照刘志军的命运,来对自己这个命运作一个判断。”

今年4月,北京市检察院对刘志军提起公诉,检察机关在起诉书中说,刘志军“非法收受他人财物,数额特别巨 大,情节特别严重﹔徇私舞弊,滥用职权,使国家和人民利益遭受特别重大损失,情节特别严重。”

大陆司法专家分析,从起诉书上看,“四个特别”属于重判的信号。而且,在中共新班子发出反腐要“苍蝇、老虎一起打”的时候,很多人预测,刘志军必死无疑。

另据北京媒体报导,案发后,刘志军受贿的赃款、及滥用职权造成的损失,被司法机关全部追缴,这其中仅房产就有374套,折合人民币超过8亿元。另外,检方起诉书中扣押的内容显示,除包括人民币、美金和港币在内巨额赃款外,还包括大量股票、公司股权、汽车、书画、饰品等。

林子旭表示,按照中共法律,刘志军贪污的数额一定是斩立决。

林子旭:“大家现在应该看得越来越清楚了,中共所谓的‘反腐’,不过就是骗人的把戏罢了,这个腐败的癌细胞,都已经蔓延到中共的骨髓里、血液里了,还怎么反呢?还有谁会相信呢?”

不过,林子旭认为,刘志军是中共权斗角力后,被抛出的一颗棋子,下一个棋子是谁,谁都保证不了不是自己。

而任百鸣表示,在目前的情况下,对于刘志军案的量刑,既要考虑能平息一下民愤,又要考虑稳固习、李政权,以及考量如何为前重庆市委书记“薄熙来案”创造一定的空间,争取更多在“薄案”上的主动权。

任百鸣:“刘案的后面,有一个更大的案子是薄熙来案,所以刘案它不是孤立的,也不是目前的重中之重,而最核心的是后面的薄案,判刘案死缓,我想是给薄案留下了更大的一种想像空间,以薄免死为界。”

刘志军是前中共党魁江泽民一手提拔起来的,也是习、李上台后,司法机关第一个公开审理的省部级官员。分析指出,刘志军一审快速轻判,与习、李高调肃贪的政策相抵触,影射出中共高层内部的内斗越来越激烈。

Liu Zhijun Reprieve: Who’s Agenda is Fulfilled?

China Minister of Railways,
has been under investigation for more than two years.
As a corrupt ministerial official, Liu Zhijun was connected
to over 400 cases, involving hundreds of Millions of Yuan.
Liu Zhijun was sentenced to reprieve on July 8.
This caused uproar when the news came out.
The reprieve seems to have become
a normal exemption for corrupt officials.
Why is there no death penalty for corrupt officials?
Who is serving as a protective umbrella for Liu Zhijun?
These questions have become a focus for public opinion.

Analysts consider that Liu Zhijun’s reprieve fulfills the
needs of other corrupt CCP (Chinese Communist Party)
officials, and also fulfills the needs of the CCP itself.

The case of Liu Zhijun, former CCP Minister of Railways,
has involved accusations of bribery and abuse of power.
The cases first trial was declared at the Beijing
Second Intermediate People’s Court on July 8.
The court declared that Liu Zhijun had provided
assistance to eleven people receiving job promotions,
getting contract projects and rail freight transport plans,
and other related crimes, involving 64.6 Million Yuan.
Finally, the court combined the punishment
for bribery, abuse of power and other crimes.
Liu Zhijun was sentenced death, with
a two year suspended sentence.

Since Liu Zhijun stepped down, it has taken
over a year for the case to reach a verdict.
Netizens have repeatedly questioned whether
there was political deal behind this case.

Commentator Lin Zixu highlights that
the CCP is full of corrupt officials.
The reprieve of Liu Zhijun should
be the hope of all CCP officials.

Lin Zixu: “In fact, the reprieve of Liu Zhijun
fulfills the needs of corrupt CCP officials.
If Liu Zhijun is sentenced to death, other officials, who may
be worse than Liu Zhijun, could also be sentenced to death.”

Commentator Ren Baiming said that the frayed nerves
of many corrupt officials would now certainly be relieved.

Ren Baiming: “The outside world agreed
that Liu was not able to escape a death.
The result is a sudden large turnaround.

The reprieve opened a small gap, and it relieved
the frayed nerves of the CCP officials a lot.
As there are many corrupt officials, they could reference
the fate of Liu Zhijun when facing their own judgment.”

In April this year, the Beijing Procuratorate
initiated the public prosecution of Liu Zhijun.
Prosecutors said in the indictment that Liu Zhijun accepted
other people’s property illegally, and on a huge scale.
The circumstances were especially serious.

It also mentioned his favoritism and abuse of power made
the country and the people suffer especially heavy losses.

China judicial experts analyzed that four uses of the words
“especially” serious were signals of a severe sentence.
The new CCP leadership team initiated anti-corruption
actions, called fighting the “flies and tigers” together.
Many people predicted a certain death for Liu Zhijun.

According to Beijing media, the proceeds from
Liu Zhijun’s bribery and abuse of power were
recovered by the judiciary after the incident.
This includes 374 sets of real estates,
amounting to over 800 million Yuan.
In addition, the content of the indictment shows that the
seizure of property also includes a large number of stocks,
as well as company shares, cars, paintings and jewelry.

It also included large amounts of money gained through
illicit means, including RMB, U.S. and Hong Kong Dollars.

Lin Zixu also said that in accordance with CCP
laws, and based on the amount of corruption,
Liu Zhijun must be sentenced to death.

Lin Zixu: “We can now see more clearly that the so
called CCP ‘anti-corruption’ is just monkey business.
The cancer of corruption has spread to the
bone marrow and the blood of the CCP.
How can you run an anti- corruption
campaign? Who will believe it?”

However, Lin Zixu thinks that Liu Zhijun is a pawn
thrown away by the CCP after an internal power struggle.
Who will be the next chess piece? No
official can guarantee is won’t be them.

Ren Baiming also comments the measurement
of the penalty for Liu Zhijun would have been
considered based on a number of issues.
To quell public anger, which stabilizes the Xi-Li regime,
and creates some space for the Bo Xilai’s case, who
is the disgraced former CCP Secretary of Chongqing.

Ren Baiming: “There is a bigger case after
the Liu Zhijun’s case, which is Bo Xilai’s case.
Therefore, Liu’s case is not an isolated
one, nor the CCP’s current priority.
The core issue is the Bo Xilai case. Liu
was sentenced to death with reprieve.
I think it will create more space for the Bo Xilai case,
which could be expected to avoid the death penalty.”

Liu Zhijun was hand-picked by
former CCP leader Jiang Zemin.
He is the first ministerial level official to face
public trial judiciary after Xi- Li took office.
Analysts point out that a fast, lenient sentence for Liu Zhijun,

who stood in conflict with Xi – Li’s high-profile anti-corruption
policy, indicates fierce infighting among CCP leaders.
