【禁闻】薄熙来案审判在即 刑期已经内定?

【新唐人2013年07月20日讯】中共前铁道部部长刘志军贪污受贿虽被判死缓,舆论却普遍认为,对刘志军“死缓”的判决“量刑过轻,有失公正”。更有消息指出,刘志军的“免死”,是在为即将开审的“薄熙来案”做铺垫。也有法律界人士分析,从对刘志军、王立军以及谷开来的审判结果可以推断,前中共重庆市委书记薄熙来很有可能被从轻发落。

前重庆市委书记薄熙来案7、8月将在山东省开庭。据《法国国际广播电台》中文网的消息来源表示,山东济南中级法院正在针对审理“薄熙来案”进行彩排模拟。

薄熙来主政重庆时期,曾经被重庆当局判刑入狱18个月的北京律师李庄,针对这一消息在香港向媒体表示,薄熙来的受审地点在济南“比较确定”,但正式开审时间可能在9月份。李庄认为,薄熙来“践踏法治”,“反人类、反文明、反进步”的罪恶,远比贪腐要大,不应该被宽恕。李庄还表示,薄熙来在重庆“打黑”的收入,都已经用完,无法归还扣押私企老板的财产,令当局不敢为这些人翻案。

《法广》的报导引述知情者的消息说,当局对薄熙来的指控将以受贿罪为主,主要案情是大连富商徐明为薄熙来幼子薄瓜瓜在英美留学提供的各项开资。

另有接近重庆市政府的消息来源向《法广》透露,薄熙来将被控收取800万人民币的贿赂,刑期将会是10年到20年。

时事评论员蓝述:“薄熙来在重庆对法制的践踏,以及唱红打黑、复辟文革这一套,他的左膀右臂就是谷开来和王立军。而这两个人的处理方面,基本上都已经避开了践踏法制以及政治方面的问题。按照这个思路来看,那很可能对薄熙来的审理就仅仅会牵扯到受贿以及对薄谷开来的包庇。”

实际上,薄熙来案件牵扯的问题远远不止这些。蓝述表示,关键是当局敢不敢去揭薄熙来真正的罪行,以及在重庆期间他所干下的这一切事情的黑幕。

尽管外界认为,薄熙来在任期间的所作所为,已经构成了“颠覆国家政权罪”,但有律师表示,依照中共惯例,这一罪名是中共为拘押异议人士而准备的。

中国东南大学法学院教授张赞甯:“当然也可能会给他定一个渎职罪、玩忽职守罪之类的一些其他罪名,我认为一般不会可能给他一个‘颠覆国家罪’,‘颠覆国家罪’的罪名一般只能用到普通异见人士头上,不可能用在像薄熙来这样的党内高官身上。”

中共当局不追究薄熙来的“政治罪行”,只对他进行“刑事审判”的作法,被舆论认为是“避重就轻”,企图“转移视线”。

蓝述:“整个外界其实最关心的,从一开始就不是薄熙来受贿了多少钱,而是王立军他出逃的时候,他带到美国领事馆的有关于薄熙来在辽宁执政期间,以及在重庆执政期间,以及他最早在大连担任市长期间贩卖人体的尸体,以及这件事情背后所牵扯的活体摘除法轮功学员器官,这些事情。这个是国际社会最关注的事情。”

还有评论认为,如果从“政治角度”对薄熙来进行审判,追究薄熙来的责任,将会给整个中共政坛带来一场大地震,这恰恰是中共当权者所惧怕的。

张赞宁:“这些东西一旦摆上台面,不光是薄熙来受到伤害,而且还会使整个(中共)党的形象受到损害。整个党就会失去它的合法性,它的地位就岌岌可危了。”

《大纪元》评论指出,像薄熙来这样的迫害人权者,迟早要偿还他们所犯下的罪行,即使在现行法律下暂时逃脱了罪责,但迟早一天会受到历史的清算。

Bo Xilai’s Forthcoming Trial: Has Sentence Already Been Decided?

China’s former Railway Minister Liu Zhijun was recently
given a suspended death sentence for corruption charges.
This was deemed “a light sentence, with lack
of impartiality”, according to the public opinion.
Someone has pointed out that Liu’s escape
from the death penalty has paved the way
for the forthcoming trial of Bo Xilai case.
Some legal professionals say that it can be inferred
from the verdicts of Liu Zhijun, Wang Lijun and Gu Kailai,
that Bo Xilai will probably be given lenient penalty.

Reportedly, the Bo Xilai case will be held
in August in Jinan, Shandong Province.
Radio France Internationale (RFI) reports
that Jinan Municipal Intermediate Court is
undertaking a rehearsal trial at the moment.

Li Zhuang, a Beijing lawyer, was jailed for 18 months
by Bo Xilai during his tenure in Chongqing.
Li told Hong Kong media that
Bo may face trial this September.
Li says that Bo’s trampling on rule of law and
his crimes against humanity are great evils.
Bo should never be given lenient sentence.

According to Li, the money that Bo amassed
from his anti-mafia campaigns against
local enterprises has all been used up.
Thus, it is impossible for these entrepreneurs
to have their seized assets returned from the
Chinese Communist Party (CCP) authorities.

The RFI report quotes an insider source, saying that the
major charge against Bo will be his involvement in bribery.
It is justified, as Dalian businessman Xu Xiaoming
had funded Bo’s son, who studied in the UK and USA.

According to another source close to Chongqing leaders,
Bo will be accused of taking bribes worth 8 million Yuan.
He will face a jail term between 10 years to 20 years.

Lan Shu, Critic: “Bo Xilai trampled on rule of law, and
launched anti-vice campaigns and of singing Maoist songs.
He did all these with the support of
two people, Gu Kailai and Wang Lijun.
However, both Gu and Wang weren’t charged for trampling
rule of law, nor for their involvement in the military coup plot.
If it continues along this path, Bo will only be
accused of work, and of sheltering Gu Kailai.”

In fact, Bo Xilai’s real crimes were far
more than these, according to Lan Shu.
The key to this case is whether or not the CCP authorities
dare to expose Bo’s real crimes, and the related darkness.

Outsiders think that Bo Xilai was engaged in “subversion
of state power" during his tenure in Chongqing.
Some lawyers consider that this particular crime is
actually only for the CCP to target Chinese dissidents.

Zhang Zanning, Professor at the Law
School at China’s Southeast University:
“It is likely Bo will be charged of various
crimes, such as abusing his powers.
I think he won’t be charged for ‘subversion of state
power’, which is generally only used on dissidents.
It is unlikely that this can be used on a
former high-ranking CCP official like Bo.”

The Chinese regime won’t investigate Bo’s
political crimes, and will only focus on his trial.
Public opinion suggests that the authorities have
avoided the major issues, but are only going
after petty issues, so as to divert public attention.

Lan Shu: “The public are not concerned
with how much money Bo has embezzled.
When Wang Lijun fled to the US Consulate, he
allegedly took documents with him that revealed
Bo’s involvement in trafficking human body parts
during his tenure in Liaoning, Chongqing and Dalian.
Behind this incident are reports of Bo’s participation
in harvesting organs from live Falun Gong practitioners.
This is the most concerning issue
for the international community.”

Some commentators said that from a political point
of view, in order to sentence Bo and to investigate
him would trigger an earthquake for the CCP.
This is what the CCP is most scared about.

Zhang Zanning: “Once this is all put on the table, not
only Bo, but also the CCP’s image will be damaged.
The CCP will lose its legitimacy, and its power is at stake.”

The Epoch Times commented that sooner or later, human
rights abusers like Bo will be punished for their crimes.
Although they have escaped punishment
for now, one day they will face justice.
