【禁闻】“6‧10”还在 中共如何依法治国?

【新唐人2014年10月28日讯】据大陆媒体披露,中共公安部副部长刘金国,接替了落马的“6‧10”办公室主任李东生的职务,这则消息显示中共江泽民集团成立的非法组织“6‧10”办公室仍然存在。在这次四中全会期间,中共喊出了“依法治国”的口号,但“6‧10”的存在,则让“依法治国”显得格外讽刺。

中共四中全会期间,大陆《财新网》突然报导了原“6‧10”办公室主任李东生下马后,由公安部副部长刘金国替补了李东生的职务,但这条消息很快就被删除了。

而被外界认为挺王岐山、亲习派阵营的《财新网》,突然打破禁忌,绝非是心血来潮。这个现象说明,时至今日,法轮功问题依然是中共当局无法面对的敏感问题。

中共所谓的“中央防范和处理邪教问题领导小组办公室”,也就是“6‧10”的“前身”,中共中央处理法轮功问题领导小组办公室。这个组织是中共前党魁江泽民避开宪法和正常的法律程序,直接下令成立的一个专职镇压法轮功的非法机构。它的成立时间是1999年6月10号,因此又被称为“中央610办公室”。

时事评论员 邢天行:“‘6‧10’的存在,本身从中国法律系统来讲,它也是不合法存在的,它原来是因为江泽民的一句话就建立起来的,但是建起来之后,作为中共党内的一个小组,它竟然能协调中国政府的所有的机构和部门,凌驾于法律之上,去操控整个国家机器去运转。”

“6‧10”小组成立之初,由李岚清、罗干等负责组建﹔李岚清、罗干、周永康先后任组长,该小组设副组长一名,即中央“6‧10”办公室主任。王茂林、刘京、李东生先后出任“6‧10”办公室主任。

谢燕益律师:“ 其实 ‘6‧10’是一个非法组织,甚至是一个黑恶组织,它是执政党内部一个,其实是举世皆知的臭名昭著,一个专门残害法轮功学员,专门残害上访或异议人士,这是一个践踏人权的黑恶组织,这个组织的成员也是一些非法的、滥用权力的罪恶分子。”

据“明慧网”报导,中国各地“6‧10”不法人员操纵公检法迫害法轮功学员,还打着“法制教育”的幌子非法私设“洗脑班”,劫持当地法轮功学员和在劳教所、监狱被非法关押期满的法轮功学员。

在北京举行的中共第十八届四次全会已结束,“依法治国”是此次会议总结的重点目标。对此,谢燕益律师表示,“依法治国”在中国具体环境当中,是不可能存在的。

谢燕益律师:“当然 ‘6‧10’的存在,肯定是跟依法治国这个原则或者主张,肯定是背道而驰的。像劳教、‘6‧10’等等,还有其他一些非法的手段措施、组织,包括黑监狱和所谓的洗脑班,你如果不铲除掉,那何谈依法治国?”

谢燕益律师表示,公权力的行使必须要依法进行,权力必须在法律的轨道上运行。

谢燕益律师:“有些当权者,仅仅一厢情愿的愿望,觉得大家来倡导依法治国,就能依法治国?不是这样的,这有它的规律。法的精神在于权力制衡,这个权力一天不受到制约,公权力一天不受到制衡,那么其实法制是不可能独成的。”

香港的时事评论员黄忠清接受BBC中文网采访时表示,中共讲的法治和西方讲的法治是不一样的概念。黄忠清认为,西方所讲的法治包括基本的民主人权,监督、限制政府和执政党的权力,但中共所讲的法治是在坚持共产党领导的基本原则下的法治。

Is the Existence of 6.10 Compatible with CCP Rule by Law

According to mainland media reports, deputy minister
of CCP Public Security, Liu Jinguo,has replaced
the sacked Li Dongsheng as 6‧10 office director.

This message means the illegal organization, 6‧10 office,
set up by the Jiang Zemin group still exists.
Although the CCP Fourth Plenary Session shouted out the
slogan “rule of law", the existence of 6‧10 office is
particularly ironic in the face of this.

During the CCP Fourth Plenary Session, the mainland Caixin
suddenly reported that sacked former 6‧10 office director Li
Dongsheng was replaced by deputy minister of Public Security,
Liu Jinguo.

However, the message was quickly removed.

It shouldn’t be a whim for Caixin to suddenly break a taboo
since it’s widely known to support the Wang Qishan and Xi
Jinping group.

It means the Chinese authorities find Falun Gong
still a sensitive issue to face.

The so-called Central prevent and deal with cults.
The Leading Group Office was the predecessor of 6‧10 office
in handling the Falun Gong issue.

This organization was set up by the direct orders of former CCP
leader Jiang Zemin, thus avoiding the Constitution and the
normal legal process.

It was set up on June 10th, 1999, and known as the Central
610 Office.

Commentator Xing Tianxing: “6‧10’s existence itself is illegal
based on the Chinese legal system, since it was set up on the
word of Jiang Zemin.

Moreover it could act above the law to control the entire state
machine and coordinate all CCP agencies and departments, at
the will of a CCP inner party faction, after set up."

Li Lanqing and Luo Gan were responsible for the 6‧10
at the start.
Li Lanqing, Luo Gan and Zhou Yongkang have served as heads successively.
The group also has an associate director, that is an office
administrator.
Wang Maolin, Liu Jing and Li Dongsheng have served as 6‧10
Office administrators successively.

Lawyer Xie Yanyi: “6‧10 is actually an illegal organization,
and even an evil organization.
The fact it’s within the ruling party is well known and notorious.
It’s designed for the specific persecution of Falun Gong
practitioners, petitioners or dissidents.

This is an evil organization for the abuse of human rights, with
members who illegally abuse power."

According to the Minghui report, people in the 6‧10 office
unlawfully manipulate public security to persecute Falun Gong practitioners;

and illegally set up brainwashing centers in private with veneer
of legal education.

They kidnap Falun Gong practitioners from local areas; or
expired illegal detention practitioners from labor camps and
detention centers.

The 18th CCP Fourth Plenary Session in Beijing has ended.
Rule of law was the major theme of the meeting.
Regarding this, lawyer Xie Yanyi said, the rule of law cannot
exist in the specific environment of China.

Xie Yanyi: “of course, the existence of 6‧10 is certainly
contrary to the principle or proposition of the rule of law.
How can you rule by law with illegal measures, and the
existence of organizations including labor camps, 6‧10,
black jails and so-called brainwashing centers?"

Xie Yanyi said, public power must be carried out according
to the law; the powers must be running on the law track.

Lawyer,Xie Yanyi: “some potentates want to rule by law,
advocating it based on their own wishful thinking.
It’s not true because of a rule.
The spirit of law lies in power balance.
Law implementation can’t be done as long as power is not
checked and balanced."

Hong Kong political commentator Huang Zhongqing told BBC
Chinese network, in an interview, that CCP law is different
from Western.

Huang Zhongqing believes western law includes basic
democracy and human rights, monitoring, government and
limitation on the power of the ruling party.

CCP’s rule by law is under the CCP’s leadership.
