【禁闻】赖昌星或免死 中共高层权斗妥协?

【新唐人2011年10月15日讯】厦门远华走私案主要疑犯赖昌星被遣返回国后,中共究竟如何处理这个案件,一直为外界所关注。13号,中共海关总署透露,对赖昌星案件以“涉嫌走私普通货物罪”来进行侦查。舆论认为,这暗示赖昌星可以免于死刑。关注远华案的分析人士指出,这是中共高层各派为摆脱目前的执政困境,而进行的妥协。

赖昌星由加拿大被引渡回中国已将近3个月了。13号,在中共国务院新闻办公室主办的记者会上,海关总署副署长鲁培军透露,赖昌星案件“目前侦查工作进展顺利”,海关缉私部门对赖昌星以“涉嫌走私犯罪”事实展开全面的侦查。

香港《明报》报导指出,从鲁培军的表述显示中共对赖昌星案件的基调,一是由海关查办,使案件单纯化,不会向政治方面发展;另外,赖昌星的罪名是“走私犯罪”,免除了判死的可能性,可以兑现向加拿大方面的承诺。至于之前引人注目的行贿及贪腐情节,将不会重点查处。

《远华案黑幕》的作者盛雪女士,一直关注赖昌星案件的发展。她认为,中共的政治体制的性质,决定它处理的方式肯定是政治挂帅。

盛雪:“在这个前提之下,他们可以根据他们的政治需要而给这个案子定性和审理,而最后给出一个他们认为适当的结果。现在它希望让这个案子实际上是以大化小,以小化了,就是想这个案子草草审结,主要是把赖昌星拿到他们手上,控制在他们手里。”

赖昌星涉及的远华集团走私案,被指从1996年至99年间在厦门走私石油、汽车、香烟等货物进口,货物总值和税额合计共830亿元人民币,被形容为1949年以来第一经济大案。当时有三百名涉案者被追究,其中被判处死刑的有14人,无期徒刑12人,刑期不等者多达58人。

而作为主犯的赖昌星,按照目前中共的定调,所涉及的走私普通货物罪,原本可以判处无期徒刑或死刑,但今年2月的刑法修正案已取消这个罪行的死刑最高刑罚,也就是说赖昌星最多会被判终身监禁。

大陆前《中国民营》杂志记者、专栏作家刘逸明表示,中国是一党专制社会,是人治不是法治。

刘逸明:“如果中国有法制的话,那很多贪官都该死,贪污一百万的绝对够死刑的,为什么没有死,贪污几个亿的都没有死,说明什么问题?中国就是人治,老百姓没有违法犯罪,它都可以治罪,但是这个贪官,他有罪或者是没罪,或者就是说,本来就是够死刑,他可能只给你判几年。”

尽管在远华案中公安部副部长李纪周等一大批高官落马,但是,对于传闻中被牵涉的江系人马如贾庆林等高官,当局却一直没有真正触及到。

盛雪:“这个执政困境是整个统治核心,统治集团共同面对的东西。而在过去的12年间,中共权力核心已经对中国社会整体的经济利益进行了切割和划分,所以他们在这当中,虽然是有较量、有斗争,但同时更重要的是,他们有默契,有彼此的妥协,实际上这个中国社会的被统治阶层、老百姓阶层才是他们整体利益的最大的敌人。”

刘逸明认为,在中国,刑不上政治局是潜规则,也更不可能上到政治局常委。所以,赖昌星回国的政治意义已经不再重要。

China’s Most Wanted Smuggling Fugitive Investigated

China’s most wanted smuggling fugitives, Lai Changxing,
was deported to China months ago. But how China is dealing
with the case has brought concern amongst the public.
On October 13th, the Chinese customs authorities have started
investigating Lai’s smuggling list. Experts believe Lai
will not get a death penalty as high-level officials need to
find a compromise to solve the current predicament.

Entrepreneur Lai Changxing was deported from Canada to China
nearly 3 months ago.
The deputy director of the Customs General Administration
(GAC), Liu Peijun,
said at a news conference on October 13th,
that the investigation is going smoothly.
Now customs officers are preparing charges against him
on account of suspected smuggling.

Hong Kong’s Ming Pao reported that according to
Lu Peijun’s report,
it seems Customs’ investigation will solely focus on
the smuggling charges and not on Lai’s previous criminal activities.
As promised to Canada, there will be
no death penalty served to Changxing.

Sheng Xue, author of the book “Yuan Hua Case” is
concerned about Lai’s condition.
Sheng thinks the Chinese Regime
will turn Lai’s case into their own political agenda.

Sheng Xue:“The CCP will deal with the case
according to their own needs.
And it will in the end give the result their consider appropriate.

Now they want to minimize the case,
and make a casual conclusion. The CCP wants mainly to have Lai in their hands.”

Lai Changxing is accused of being the chief leader of a
Xiamen smuggling ring since the 1990’s.
He is suspected of smuggling goods worth 83 billion Yuan,
these being mainly oil, cars and cigarettes.
It’s said to be the top economic crime since 1949.

Three hundred suspects have been investigated,
of which 14 were sentenced to death.
Another 12 were sentenced to life imprisonment.

According to CCP law, Lai Changxing would
have been sentenced to death,
but the Criminal Law was amended last February,
canceling the death penalty.
This means the maximum penalty for Lai
would be life imprisonment.

Liu Yiming, former correspondent and columnist
for the China Private Magazine,
says that China is under a one-party totalitarian rule
and it’s controlled by officials, not by the rule of Law.

Liu Yiming:"If China has a legal system,
then a lot of corrupt officials should be sentenced because most of them have stolen more than
one million RMB.
Why didn’t they die?
Even the ones who stole billions didn’t die?
It means China is controlled by men.

That’s the reason why civilians can be punished
even if they did nothing criminal, but corrupt officials are said innocent.
Or if their crimes should be a death sentence,
they only get a few years of detention.”

In Yuanhua’s case, a bunch of senior officials were sacked,
including the Vice Minister of Public Security Li Jizhou.
But higher level officials, such as Jia Qinglin,
haven’t been touched.

Sheng Xue:“The ruling group has a dilemma,
and the core group of the CCP’s regime faces the same issue.
In the last 12 years, CCP senior officials have cut
and shared all of their profits made from China’s civil population.
Although officials have struggled and contested
amongst each other, the most important thing is that
they had to compromise in order to
maintain this kind of shared benefits.
In fact, to the ruling class,
the civilian population is their biggest enemy.”

And as Liu Yiming says, China has a hidden rule:
the Politburo will never be punished, and
the Politburo Standing Committee will always be innocent.
In this light, the political nature of Lai Changxing’s case
is no longer relevant.
