【新唐人2013年06月05日讯】北京当局最近通过对律师的年度考核,大规模打压维权律师。5月31号,是北京市司法局规定的年检截止日,有一批维权律师及事务所没能通过年检。有消息指出:北京市司法局利用年审和年检的机制,掀起了新一轮严厉打压维权律师和律师事务所的行动。
6月2号,总部设在美国的非政府组织“对华援助协会”表示:4月1号至5月31号,是北京市司法局定下的全北京律师事务所的年检期限。5月上旬,北京一千多家律师事务所中99%的律师事务所都通过了年检,并且给律师颁发了新的律师执照。但是,还有一批正义维权律师事务所未能通过年检。
报导说,北京市司法局以各种不敢公开的理由,拒绝让十所左右的律师所和十多位律师通过年检,以阻止他们获得新的律师执照。
6月1号凌晨,北京律师江天勇在推特发出消息说:王全章、兰志学、张全利、梁小军、黎雄兵、董前勇、蔺其磊、郭海跃、陈继华等律师现仍未通过考核。
不久,江天勇再发消息补充说,又了解到李柏光、李敦勇、刘培福、邬宏威、谢燕益、王雅军等维权律师,和他们所在的律师所,都未能通过本年度考核。另外,重庆“竞豪”律师所的熊代英律师,因参与公民聚餐和代理法轮功案件,也未能通过年度考核。
江天勇说,这些律师大多参与了各类维权案件,尤其是法轮功案件。江天勇认为,中共当局就是通过这种集体绑架,让一个律师事务所的其他律师给维权律师施压。
6月4号,《新唐人》致电“未能通过”年检的北京维权律师王全章,他表示,司法局反复以文件不齐全等借口,拖延核发证件。
而3年前已被吊销执照的北京维权律师唐吉田指出,当局对律师的年检本身就是非法。他猜测,虽然今年的年检已经结束,但是,也不排除这些人被当局警告,或者,答应当局的条件,而通过年检,重新恢复职业。
北京维权律师唐吉田:“但是,我估计,这十几个人应该绝大部分都不会被停止职业,但是,时间可能会拖的长一点,这取决于社会形势的变化,也取决于他们个人的努力,更主要的还是官方,它如果能达到敲榨这些人的目的,它也不见得再像以前似的,全部用明枪,它更多的是用暗箭。”
2010年4月30号,北京市司法局吊销了唐吉田的律师执业证书。唐吉田指出,当局往往通过年检,对维权律师和律师事务所进行打击报复。
唐吉田:“这些事情都不会有什么能讲得出的理由,随便编一个,它也不允许你申辩,也没有一个公开的,独立的第三方的一个体系,基本上是欲加之罪,何患无辞。一零年吊销的时候,它说是‘扰乱法庭秩序’,也是颠倒黑白,事实上是:法庭不允许当事人和律师依法进行诉讼活动,然后它们就倒打一耙。”
中国资深法学专家赵远明指出,中共当局作为国家政府的权力机构,用这种手段整治律师和律师事务所,非常卑鄙。
中国资深法学专家赵远明:“因为这些律师并非说他们徇私枉法,或者有什么搞黑的勾当,不是,而且这些律师,主要是为了异见人士或者信仰人士进行法律服务,进行法律工作,这种情况下,实际上是得罪了中共当局。”
赵远明指出,虽然新一届领导人上台了,政法委系统换人了,但是很多人依然在贯彻执行江泽民派系镇压民众的政策,用年检的方式,对正义律师进行多方的刁难。

Beijing Judicial Bureau refuses licenses of rights defense lawyers
The Beijing authorities pressured human rights lawyers
on a large scale over annual license renewal.
According to Beijing Judicial Bureau (BJB), lawyers
must present their annual applications by May 31.
Some human rights lawyers and law firms
were denied renewal.
Sources said that BJB took this opportunity
to implement a severe suppression of lawyers.
On June 2, the US-based non-governmental organization
China Aid stated that according to BJB,
the annual license renewal period runs
from April 1 to May 31 in Beijing.
In early May, 99% of Beijing’s more than 1,000 law firms
passed their annual renewal and received their new licenses,
but some human rights law firms failed the annual review
and did not receive their licenses.
Sources have said that for unspecified reasons, BJB denied
10 law firms and more than 10 lawyers’ annual review,
so as to prevent lawyers from license renewal.
On the morning of June 1, Beijing lawyer Jiang Tianyong
tweeted, “Lawyers that haven’t passed review include
Wang Quanzhang, Lan Zhixue, Zhang Quanli, Liang Xiaojun,
Li Xongbing, Dong Qianyong, Li Qilei, Guo Haiyue and Yang Jihua.”
Jiang Tianyong added that human rights lawyers including
Li Boguang, and six others and their firms, failed annual reviews.
In addition, lawyer Xiong Daiying at Jinghao Law Firm was
also denied by BJB due to his participation in civic gatherings and handling of Falun Gong cases.
Jiang Tianyong said that most of these lawyers were involved
in various human rights cases, especially Falun Gong cases.
Jiang believes that the Chinese regime failed lawyers
and firms in order to pressure other human rights lawyers.
On June 4, NTD contacted lawyer Wang Quanzhang,
who was denied annual renewal.
Wang said that BJB told him his document was incomplete,
thus they haven’t renewed his license.
Tang Jitian, a Beijing human rights lawyer whose
license was cancelled three years ago, said that
the Chinese regime’s annual license renewal
for lawyers is itself illegal.
He speculated that although this year’s licenses renewal
is closed, the authorities likely have coercively promised
those who were warned that if they accept authorities’ terms,
they will pass the annual renewal and can resume work.
Tang Jitian: “I guess the majority of these lawyers won’t
be stopped from working, but their job can be put on hold.
It depends on the changes of the situation in the
society and lawyers’ individual efforts.
The authority is the main thing, if they can achieve
their purpose of blackmailing these lawyers,
it is unnecessary to act openly as they did in the past,
and mostly they will act behind the scenes.”
On April 30, 2010, BJB cancelled lawyer
Tang Jietian’s practice license.
Tang said the Chinese regime tends to retaliate against human
rights lawyers and law firms via the annual license renewal.
Tang Jitian: “The authority won’t give any proper reason,
they just casually compiled one.
They won’t allow you to appeal and there is no openly
third-party independent system available;
if they want to find fault with someone,
they will make excuses.
When they revoked my license in 2010, they claimed
that I have ‘disrupted courtroom order’.
They inverted black and white.
The fact is that the court didn’t allow one party and
lawyers to carry on with law proceeding.
Then they falsely accuse me.”
Zhao Yuanming, law system expert, said that
as a country’s authority,
the Chinese regime’s use of this means to suppress
lawyers and law firms is very disgraceful.
Zhao Yuanming: “These lawyers didn’t abuse power
or (engage in) corruption.
These lawyers have mainly served to help dissidents
and help people who have beliefs.
In this regard, these lawyers have offended
the Chinese Communist Party.”
Zhao Yuanming said that although new leadership
took office,
and the Central Politics and Law Commission
has substituted members,
many are still implementing Jiang Zemin’s
suppression policy.
They used the annual license renewal
to make things difficult for lawyers.
