【新唐人2013年07月17日讯】已被湖南当局枪决的湘西房地产商人曾成杰的儿女—-曾贤和曾珊,7月15号到长沙看守所领取父亲遗物,警方拖延到下午才给。看守所狱警告诉他们,曾成杰直到12号当天,才知道大限已到,而且看守所狱警同样当天才知道要对曾成杰执行死刑处决。狱警还说,核准曾成杰死刑的消息一直没有下来,这是“绝密”。至今,曾成杰的辩护律师也没有收到死刑复核判决书。
曾珊兄妹15号一大早到长沙看守所领取曾成杰遗物,他们在办公室隐约听到所长接电话说﹕“你说先不给是吧?好,那我拖一会儿。”然后干警就带他们到一个会议室,说领导开会去了,要他们等待。
曾珊16号告诉《新唐人》,他们等到下午才领到父亲的遗物,包括:两封信和一些衣物。一封信是给哥哥曾贤,一封是给律师。
湖南房地产商人曾成杰女儿 曾珊:“我们昨天下午拿到的不是遗书,就是两封信,一封是给我哥的,是6月1日的,还有一封是给律师的,是7月2日的,都没有提到他说什么知道自己要被执行(死刑),都是还在积极的上诉。”
因长沙中院未通知家属就对曾成杰执行死刑,并发微博解释“法律没有明文规定,对犯人执行死刑时,犯人必须跟亲人见面。”而激起舆论炮轰。随后,长沙中院再补充说﹕对曾成杰执行死刑前“验明正身时”,法官告知他有权会见亲属,但曾成杰并没有提出此要求,在他的遗言中也没有提出。
曾珊根据这份微博向看守所索取父亲遗嘱,看守所说这两封信就是遗书。但曾珊表示,曾成杰的两封信中丝毫没有提及所谓身后的遗言。
曾珊:“然后我哥哥问了看守所的人,就说我爸爸被执行的前一天,知不知道自己第二天会死。看守所的人就说,连他们看守所的人都不知道,一直没有消息说核准已经下来。那个人说这个是绝密。他们都是第二天早上才知道。我爸应该也是第二天早上才知道。”
曾珊将要求法院拿出微博上所谓的“遗言”,来证明曾成杰没有提过死前要见家属的要求。
曾珊:“11.15因为根据他们在微博上的回复,看来是说父亲有一个遗嘱。所以我们要写一个申请书,跟他们申请要这个遗嘱。”
曾成杰的辩护律师王少光表示,湖南当局将曾成杰的房地产开发公司资产,低价变卖给自己的独资公司,隐匿资产足以还债的评估报告,把政府打压融资行为引起的后果,全算在曾成杰头上。同时,当局为了杀人灭口,竟然无视已经在卷的“铁证”而随意定案。
曾珊也认为她的父亲绝不构成“非法集资”罪,因为没有构成非法集资的要件,包括:曾成杰没有挥霍,没有非法占有,没有转移、隐匿资产,融资款项也都用于生产经营。她说,如果不是因为曾成杰被捕入狱、和公司资产被秘密贱卖,曾成杰一定能还钱。
曾珊:“在我印象中他非常的勤劳,天天都泡在工地上,特别简朴,有时候在工地上面都是吃盒饭,在我印象中都是特别的勤劳简朴。然后还很善良,地震的时候还亲自奔赴灾区,还修了希望小学。”
曾珊7月13号才从媒体得知,曾成杰的死刑核准书6月14号已下达。但是她在微博的访谈中说,她在6月14号还会见了最高院刑二庭的法官,法官当时说一定会查清所有证据,不受湖南官员的影响,让她相信法律。当时,法官并没有提到曾成杰的死刑复核已经下达。曾成杰的辩护律师王少光至今也没有收到最高法院的死刑复核书。
曾珊对网友说,义务协助的法学专家律师团将在近期组成,以讨回曾成杰应得的部分,希望将来能全部返还融资群众的钱。
曾珊兄妹7月15号从殡仪馆领到父亲骨灰。16号前往父亲的家乡邵阳市,准备给父亲—-曾成杰下葬。

Zeng Chengjie’s Execution Kept Top Secret
On July 15, Zeng Xian and Zeng Shan went to Changsha Detention Center to collect their father’s possessions. The police there delayed the process, and did not return the possessions until the afternoon. Zeng Xian and Zeng Shan were the children of Zeng Chengjie, a real estate businessman from Xiangxi, who was executed by Hunan authorities. Guards in the detention center told them that their father did not know the execution was taking place until July 12. The guards also received the execution notice on the same day. The guards also told them that they have not received approval of the execution, as it classified as “Top Secret”. So far, the lawyer of Zeng Chengjie has not received notification of the death penalty verdict.
On the morning of July 15, Zeng Shan and Zeng Xian went to Changsha Detention Center to collect their father’s possessions. They explained that they overheard the director talking on the phone in the office. The director said: “You mean we don’t give them right away? OK, I will let them wait.” The police took them to a conference room. They were told that the management were out at a meeting, and they were asked by the police to wait.
Zeng Shan spoke to NTD Television on July 16. They waited there and received their father’s possessions in the afternoon. This included two letters and several items of clothing. One of the letters was for Zeng Xian, and the other letter was for the lawyer.
Zeng Shan: “We just got two letters yesterday afternoon, instead of a testament. One letter was for Jeng Xian, which was written on June 1. The other letter was for my fathers lawyer, written on July 2. He did not mention anything about his execution within the two letters. He only mentioned an appeal.”
Changsha Intermediate People’s Court did not notify Zeng Chengjie’s family about the death penalty. The court also posted information on weibo. It explained that “there is no provision requiring that we must let prisoners meet with their loved ones before they are going to be executed according to law.” This message aroused a bombardment of public comments. Subsequently, Changsha Intermediate People’s Court added:“The judge gave Zeng Chengjie the right to meet relatives before he was going to be executed. However, Zeng Chengjie did not make this request, even during his last words.”
Zeng Shan asked the detention center to return their father’s court testament, based on the microblog message. The detention center said the two letters are the testament. Zeng Shan said that their father did not mention anything about any so-called last words.
Zeng Shan:“Then Jeng Xian asked people in the detention center if my dad knew he would be executed? They said nobody that no one in the detention center knows that, as there is no notice of approval for the execution. One person in the detention center said this case is a top secret. They got the execution message the next morning, and so did my dad.”
Zeng Shan asked the Court to release any “last words” in a microblog, to prove Zeng Chengjie did not want to see his family before his death.
Zeng Shan: “According to their information on the microblog, it seems that father had a testament. Therefore, we want to write an application to ask for the testament.”
Wang Shaoguang, Zeng Chengjie’s lawyer, said the Hunan authorities sold the assets of Zeng Chengjie’s real estate development company to a government owned company, and at a very cheap price. The Hunan authorities hid the assessment report, which indicated the assets of the company were sufficient to repay the debts. The Hunan authorities let Zeng Chengjie take the responsibility of the consequences, led by the government who suppress this financial behavior. In addition, in order to get rid of Zeng, authorities ignored “irrefutable evidence”, and made arbitrary decisions.
Zeng Shan also believed that her father never committed “illegal fund-raising” crimes. There is no evidence of illegal fund-raising. Zeng Chengjie did not squander, nor illegally possess funds, nor did he transfer or conceal assets. The monetary amounts were also used in production and operation. Zeng Shan said that if Zeng Chengjie was not arrested or jailed, and if the company’s assets were not secretly sold, Zeng Chengjie would be able to pay the money back.
Zeng Shan: “In my impression, my father was very industrious. He worked on site every day. He lived a very simple life. Sometimes he ate a boxed lunch at the site. In my impression, he was very industrious and simple. He is also very nice. When the earthquake happened, he also went to the disaster area personally. He built a ‘Hope Primary School’.”
Zeng Shan learned from the media on July 13 that the approval of Zeng Chengjie’s death penalty would be issued on June 14. Zeng Shan said in an microblog interview that they met the judges of the Supreme Court Criminal Court on June 14. One judge said they will identify all the evidence at that time and they will be free from the influence of Hunan officials. The judge let them believe in the law. At that time, the judge did not mention the death sentence had been issued. Zeng Chengjie’s lawyer Wang Shaoguang has currently not received a Supreme Court death penalty review document.
Zeng Shan told netizens that a legal expert group composing of lawyers, who provide voluntary help will be established in the near future. The lawyers wanted to recover Zeng Chengjie’s money. They also hope to return the money back to the public.
Zeng Shan and Zeng Xian received their father’s ashes from the crematorium on July 15. They went to Shaoyang, their father’s hometown on July 16 to bury their father, Zeng Chengjie.
