【禁闻】作者追究马三家调查组诽谤责任

【新唐人2013年04月25日讯】大陆《Lens视觉》杂志记者袁凌,在最新一期杂志报导了《走出“马三家”》文章,辽宁当局迅速成立调查小组,声称将针对文章中,亲身经历劳教所酷刑者所描述的事实真相展开调查。日前,马三家调查报告出炉,但袁凌提出声明说:要与辽宁教养院当庭对质,并要追究制造假新闻的调查组人员,和《法制网》记者、以及《新华网》等诽谤责任。

辽宁省调查“马三家劳教所”酷刑虐待被劳教人员的报告说,“《走出“马三家”》一文内容严重失实”。

报导“马三家”的袁凌,北京时间4月22号13点42分,在新浪实名微博发表声明,他说:“建议辽宁教养院起诉本人,双方当庭对质,出示人证物证。若我果然造谣污蔑,尽可追究刑责。若报导属实,也请法庭追究教养所虐待者以及包庇的司法厅官员刑责。此外,要公开调查组成员名单,追究制造假新闻的调查组人员和法制网记者霍仕明、新华网的诽谤责任,向本人赔礼道歉,消除恶劣影响。”

这份声明被新浪微博删除,但是被拷贝储存在“自由微博”网站上。

袁凌在微博上还曝光辽宁省司法厅调查工作领导小组4月9号的密件,密件要求调查组“按照省委,省政府领导的指示和省厅党组的部署,力争在3-5天内完成调查工作,争取时间开展舆论应对和正面舆论引导工作,掌握舆论工作的主动权。”

袁凌还披露,当初他到辽宁省司法厅及劳教局采访时,被推三阻四踢皮球。找劳教局地址就费了半天,原来隐藏在一家豪华的歌厅门面之后。当时办公室人员拒绝他的采访并且说,想怎么写就怎么写。

与《Lens》杂志同属中国《财讯》传媒集团的《财经》杂志副主编罗昌平,4月22号在微博贴文,他向《人民网》的两名记者致敬,因为他们作为调查组受邀成员,拒绝在“内容严重失实”的结论上签字。

《新唐人》致电罗昌平,他表示不方便接受采访。

《新唐人》记者:“那两个《人民网》的记者,他为什么参与了调查组呢?”

大陆《财经》杂志副主编:“调查者他邀请了媒体的人员。从一开始公开,你可以查一下那条新闻。中央的一些媒体,包括中央媒体驻辽宁的,他们都邀请了。”

记者:“那他们具体进行了哪些调查?是如何调查的呢?”

罗昌平:“这个不知道。不好意思。我不方便接受采访。”

记者:“那这个调查组由哪些人组成呢?”

罗昌平:“你在网上查一下。网上有网友把他们弄出来了。有司法部的,然后他们劳教局的局长,也是一个副组长。”

在调查组“结论”发表的当天——4月20号中午,党媒《光明日报》下属的《光明网》刊登评论员文章:《马三家、打的报导失实,真相是什么》。

报导说,以《走出“马三家”》一文所描述的情节,如果其中事实为真,则虐待被劳教人员的施虐者已然构成刑事犯罪。

报导认为,走法律程序,让两造对簿公堂,由此就更容易使真相大白于天下。

大陆民间独立学者郑志遥认为,马三家黑幕的披露,和调查组结果的出炉,以及《光明网》的反击,反映出中共高层的分裂和搏击。

大陆民间独立学者 郑志遥:“我认为马三家的事情,就是在一个我们大家都看不到的黑箱子或者幕后,有人不小心拉开一道缝隙,让人看到舞台后面,啊,后面很乱。”

郑志遥表示,辽宁调查组的副组长,就是原来“马三家教养院”的院长。他们成立的调查组,肯定是掩盖。

而大陆自由作家王藏表示,从中共建政以来,一直以“反人类”等各种暴行对待民众。辽宁调查组断然否认马三家的酷刑虐待,正是中共极权暴政一以贯之的做法。

Masanjia Torture’Denial Challenged by a Reporter

Yuan Ling, China-based Lens magazine journalist, published
an article, “Walking out of Masanjia" in the latest issue.
Liaoning authorities quickly formed an investigation team,
claiming to find the truth of Masanjia torture incidents.
They came up with an investigation conclusion, however,
Yuan challenged the Liaoning labor camp to meet in court.
In addition, Yuan requested authorities to punish
those who made false news,
which involves members of the investigation team,
and reporters of the Legal Daily website,
plus a reporter from the Xinhua news website;
they should be all punished for defamation.

The investigation report said,"‘Walking out of Masanjia’
article is seriously inconsistent with the facts."

At 13:42pm on April 22, Yuan Ling posted a statement
on Sina microblog: “I suggest Liaoning Labor Camp sue me.
We, both sides, can meet in court,
bringing in witnesses and evidences.
If I really fabricated the article,
you can charge me.
If my report is true, please hand in to the Justice Department
the Masanjia’s abusers and those shielding the criminals.
In addition, please publicize the name list
of the investigation team.
Please punish those involved in making false news
in the investigation team, including Legal Daily reporter Huo Shiming, and reporters of the Xinhua website.
They need to send apologies to me,
in order to rectify the bad impact they had on me."

Yuan’s statement was deleted from Sina microblog,
but a copy was saved in freeweibo.com.

There Yuan exposes a secret document from Liaoning
Justice Department Investigation Team on April 9.
The file says,"In accordance with the orders from leaders
in provincial government and party committee, the investigation must be done in 3-5 days;
win some time to deal with public opinion,
and positively guide the public opinion;
grasp the initiative of the opportunity
to work on the public opinion."

Yuan also revealed that when he went to Liaoning Justice
Department and Labor Bureau to do the interview, they gave him many excuses to pass the ball around.
He spent half a day just looking for the Labor Bureau’s address,
finding it to be located behind a luxury karaoke club.
An official clerk there refused him an interview,
and told Yuan to write whatever he likes.

On April 22, Caijing magazine deputy editor,
Luo Changping posted messages on a microblog.
He sent his respects to the two journalists of Renmin website,
who were members of the investigation team, but refused to sign the fabricated conclusive report.

NTD contacted Luo Changping for an interview.

NTD reporter: “Why were the two Renmin website"
Luo Changping, Caijing deputy editor:
“The investigators invited these journalists.
Earlier, they publicized the news,
one can search for that online.
They invited media from the central government,
including Liaoning branch media, they were invited."

NTD reporter:"What investigation did they do?
How is being proceeded?"
Luo Changping:"I don’t know about it. I am very sorry,
it is not convenient for me to give interviews."
NTD reporter:"What kind of people
were in the investigation team?"
Luo Changping:"This can be searched online.
Netizens had posted about it.
It had Justice Ministry’people, and a Labor Bureau’director,
he was also a vice leader of the investigation team."

On April 20, the day of the investigation report release,
state-owned media Guangming published an editorial article,
titled,"Masanjia, Fabricated Taxi Report (referring to
a recent report on Xi Jinping’Taxi Ride,) What Is True?"

The article said that according to"Walking out of Masanjia"
the abusers who tortured inmates had committed crimes.

The article stated that following the proceedings,
both sides will need to meet in court to clarify the truth.

Zheng Zhiyao, a scholar in Mainland China,
believes that the exposure on Masanjia’s torture,
the investigation team’s conclusion, and Guangming’s
response reflect Chinese Communist Party (CCP) top split.

Zheng Zhiyao:"I think Masanjia incidents happened behind
the scene; someone accidentally opened the curtain and people saw the back stage, ah, what a mess!"

Zheng said, the vice head of the Liaoning investigation team
was a former director in the Masanjia Labor Camp.
Thus, this investigation team was formed
for covering up the truth.

Wang Zang, Mainland’s freelance writer said, since its dawn,
CCP hasn’t stopped committing crimes against humanity.
Liaoning’s investigation group categorically denied
the facts of the brutal tortures in Masanjia.
This is just another example
of CCP’s dictatorship doing what it always has.
