【禁闻】陆媒﹕法律没脸见唐慧

【新唐人2013年07月05日讯】引发舆论强烈关注的湖南永州“上访妈妈”唐慧,状告永州市劳教委赔偿案,二审于7月2号在湖南省高院开庭。但被告–“永州劳教委”负责人在法庭上拒绝承认劳教唐慧的决定不合法,省高院也没有做出宣判。对此,有大陆媒体为唐慧不平并宣布:不是唐慧没脸见人,是法律没脸见唐慧。请看报导。

湖南省高院庭审唐慧告永州市劳教委的案件,围绕三个焦点进行:唐慧劳教案是否有事实和法律依据﹖如果需要赔偿,应该以什么样的方式、和数额赔偿?永州市中级法院一审是否事实清楚?判决是否合法﹖

2号当天审理完毕后,审判长宣布:双方存在重大争议,案件将择期宣判。

“唐慧案”可以追溯到2006年,她11岁的女儿遭强奸并被逼卖淫,唐慧随后开始了长达七年的上访﹕去湖南省会长沙一百多次、去北京23次,被数次刑拘,还被以“闹访”的罪名判劳教一年半。少女受害,母亲反被劳教,引发了民众舆论的强烈批评,“唐慧案”被称为中共劳教制度的又一大丑闻。

在巨大的舆论压力下,湖南省劳教委撤销了对唐慧的劳教决定。

今年1月,唐慧起诉永州市劳教委并索赔2463.85元,永州市法院在4月的一审中,判唐慧败诉。

这次的被告,除参加一审的永州劳教委办公室主任罗功军以外,还有永州劳教委法定代表人蒋建湘。蒋建湘作为永州市副市长兼永州市公安局长,曾在庭审中当庭表示愿意“放低姿态,给予赔偿,甚至给予赔礼道歉”。

唐慧在二审开庭前透露,5月底湖南省高院曾出面试图调解此案,永州市劳教委答应她诉讼请求中的补偿金额并口头道歉,并再提供10万元的生活补助,但不能公开此事。但唐慧表示,“我不能在黑暗中接受你们的钱。”

北京维权律师唐吉田认为,当局的管理方式就是“我管你就要服、我压你就要听”这样一种思路,从没有把民众作为权力主体。唐吉田指出,当局这样做只能使社会局面走向更坏。

北京维权律师唐吉田:“劳教没有任何合法性的,那么以劳教这种方式来阻碍公民行使权力,这本身就是一种:轻则行政违法、重则有可能是一种刑事犯罪。”

7月2号,当唐慧出现在湖南省高院大门外时,不少人立即将她团团围住,“唐慧,我们支持你”的喊声此起彼伏。

7月3号的《河南商报》也声援这位“上访妈妈”,并怒斥法律不公,《河南商报》表示:“上访妈妈唐慧案二审,如果没有公正的判决,我们将一直给唐慧打马赛克。对不起,唐慧!不是你没脸见人,是我们没脸见你,是法律没脸见你。”

大陆人士唐先生:“目前中国所谓的法院、所谓的这些,都是一些纯粹跟土匪、地痞流氓差不多的,就是蛮横霸道不讲道理。整个党国体制都是这样,都是蛮横霸道,不讲道理。”

“唐慧案”代理律师浦志强对《法国国际广播电台》表示,唐慧之所以能够走到今天这一步,在很大程度上是地方政府无所作为,胡作为和乱作为的结果,以至于整个警察队伍几乎无官不贪,包娼包赌。从道德完整性来说,唐慧案件比什么案件都更能突出体现、至少永州和湖南老百姓的正常生活,悲惨到什么样的一个程度。

Mainland Media: The Law is Ashamed of facing Tang Hui

A lady who’s come to be known as the “Petition Mother,”
Ms. Tang Hui of Yongzhou city, Hunan province,
has grabbed media and the public’s attention.

She’s suing the Yongzhou City Detention Commission,
seeking reparations for her unjust treatment.
The hearing of the second trial opened on July 2nd in
Hunan Provincial High Court.
However, the defendant, the head of the Yongzhou City
Detention Commission, refuses to admit that Tang Hui’s
detention was illegal.
The court hasn’t handed down a sentence either.

Some mainland media feel it’s unfair to Tang Hui,
saying “it isn’t Tang Hui who is ashamed;
it’s the law which is ashamed of meeting Tang Hui.”
Our reporter has more on the story.

Hunan Provincial High Court’s trial for the case of Tang Hui,
who’s suing the Yongzhou City Detention Commission,
focuses on three points: Was there legal basis for her detention?

If reparation is needed, what form should it take,
and how much should be compensated?
Did the Yongzhou City Intermediate People’s Court have
clear facts and legitimate judgment in Ms. Tang’s first trial?

After the trial on July 2nd, the presiding judge said

“there is significant controversy of both sides. Sentencing
for the case will be scheduled for a later date.”

Tang Hui’s case goes back to 2006, when her 11-year old
daughter was raped and forced into prostitution.
That’s when Ms. Tang started a seven year long petition.

She went to Hunan’s capital, Changsha,
over a hundred times, and Beijing 23 times.
She got detained several times, and was then sentenced
to Reeducation Through Labor for one and half years.
A teenager became a victim, and her mother was
put into forced labor for speaking out,
evoking strong criticism from the public.
The “Tang Hui case” is known as another big scandal of the
Communist regime’s Reeducation Through Labor System.

Under enormous pressure from public opinion,

the Hunan Provincial Detention Commission
withdrew the detention decision.

In January this year, Ms. Tang sued the Yongzhou
Detention Commission, demanding compensation for over 2,400 yuan ($400).
Ms. Tang lost in the first trial,
held at Yongzhou City Court in April.

Defendants in the second case are Luo Gongjun, Office
Director at the Yongzhou Detention Commission,
and Jiang Jianxiang, Yongzhou Detention
Commission’s legal representative.
Jiang Jianxiang, who is also Yongzhou City’s vice Mayor
and secretary of the Public Security Bureau,
said in court that they are willing to “lower the profile,
compensate and even apologize.”

Ms. Tang said before the second trial that at the end of
May, Hunan Provincial Court tried to mediate the case, and
Yongzhou Detention Commission promised to compensate,
apologize, and give 100,000 yuan allowance,
but she isn’t allowed to publish this matter.
To this, Ms. Tang said “I can’t accept your money in the dark.”

Beijing human rights lawyer Tang Jitian says the reasoning
of the authorities’ rule is such that “If I control you,
you must follow. If I suppress you, you need to listen”.

The authorities have never put the people
as the main body of power.
Tang Jitian says the authority could only
make the society’s situation worse.

Tang Jitian: “Reeducation Through Labor has no legitimacy.
They just use it to block citizens’ exercising their rights,
which itself is a kind of administrative offense
or even a criminal offense.”

On July 2nd, when Ms. Tang Hui appeared
outside Hunan provincial court,
many people immediately surrounded her and
shouted “Tang Hui, we support you.”

On July 3rd, Hengnan Daily also showed support for
the “Petition Mother”, and strongly criticized the injustice.
They said that “if there is no fair sentence for
petition mother Tang Hui’s second trial, we will
always put mosaics on her (feel guilty to face her).
Sorry, Tang Hui! It isn’t you who is ashamed,
it’s us who are ashamed of meeting you,
it’s the law which is ashamed of meeting you”.

Mr. Tang from mainland China: “The current
so-called courts and so on in China are simply bandits,
the same as hooligans, and are just unreasonable.

The Party’s whole system is like this:
Rude, overbearing and unreasonable.”

Tang Hui’s lawyer, Pu Zhiqiang, said to
Radio France Internationale that
the reason Tang Hui has gotten this far is because the
local government is incapable of doing anything.
It’s almost to the point that the whole police force is corrupt.

From a standpoint of morals, Tang Hui’s case reveals
more than any other case how tragic life is for ordinary
people living in Yongzhou and Hunan.
