【新唐人2013年07月25日讯】近来,中国的知识界、法律界及网民,都在关注北京法律学者许志永被当局刑事拘留一事,并且提出“新公民运动”口号。7月22号,大陆知名学者茅于轼、企业家王功权及媒体人笑蜀等人,发起了《许志永事件之公民社会抗议书》联署签名活动,签名人数至24号凌晨已达400多人。抗议书呼吁当局停止对“新公民运动”的打压。
《许志永事件之公民社会抗议书》称许志永为“新公民运动发起人”,并指出,在许志永被刑拘之前,警方已经刑拘或正式逮捕了“新公民运动”的至少15名参与者。
抗议书说,这是一起极其严重的事件。从远处说,是对斯大林模式的所谓“无产阶级专政”的延续,从近处说,是对十年刚性维稳的延续,就当下说,更是对中共领导人习近平承诺的“全面实施宪法”的公开背弃。而“新公民运动”是以温和理性的方式,推进中国公民社会建设,许志永及其伙伴们的行动,是在践行现行宪法第35条,完全处于合法范围之内,对他们的打击压制则是对宪法与法律的公然践踏。
去年11月,许志永发表致中共领导人习近平的公开信——《一个公民对国家命运的思考》,信中批评中共当局为“维稳”对民众实施高压政策。
7月16号,许志永在被非法软禁三个月之后,被北京市警方以“涉嫌聚众扰乱公共场所秩序”的罪名正式刑事拘留。
北京法律学者许志永之律师刘卫国:“就是因为他们(中共当局)已经明确不让我会见,所以我星期五(7月19日)从北京回来以后,今天没有再去北京。我最近这几天会连续的提出一系列的控告。”
19号,中共喉舌《人民日报》海外版,则发表清华大学学者胡鞍钢的文章——《人民社会为何优于公民社会》,引起了不少中国大陆学者和网民的批评。
“公民非暴力不合作”发起人唐荆陵:“这个不排除当局是有计划的那么来做,它在舆论的领域它如果能争取一定的空间,都尽可能的去争取,如果争取不了,那么它可能会采取另外的手法,就是叫作抹黑的手法。尤其像今天的中国民间社会,公民的力量已经有一定成长的情况下,当局这种手法就变得更加多样化。”
致力于维护公民权利的中国法律工作者滕彪,曾以专文论述“中国新公民运动”,他指出,今日中国依然没能走出专制,强权垄断、贪腐横行、贫富差距、暴力强拆、教育失衡、社保黑洞……。一系列重大社会问题的根源都是专制,中华民族需要一场顺应历史潮流的、伟大的公民运动。
唐荆陵:“当局它对公民这个理念,以及,像公民不合作、像非暴力抗争,这种能够积极有效的带来民主化、带来自由,和有人权保护的国家这样一种前景,它是感到恐慌的,所以它决定在理论上进行混淆。”
中国“公民非暴力不合作”的发起人唐荆陵表示,中共目前恐惧的正是中国公民协同度的提高,因此当局执意打击民主运动的街头化。
唐荆陵:“所以这一次如果当局这样打压新公民运动,我相信新公民运动的参与者和那些潜在的同行者,可能会越来越坚定,对这个理念、对这个行动会有更深切的了解,并且会更积极的参与。但是我想他们为自由所做出的斗争,并不会因此(被打压)而停止,他们的价值也不会消失,反而这个价值会因为这一次的坐牢有所增加。”
滕彪指出,公民不是草民,公民是国家的主人,执政者的权力必须来自全体公民的选举。中国应永远告别“枪杆子政权”的野蛮逻辑。

Xu Zhiyong’s new Civic Movement Rising up
Recently, attorney Xu Zhiyong was detained by the
Beijing authority, who are concerned about intellectuals,
the legal profession and netizens in China.
They proposed a slogan- “New Civic Movement".
On 22nd July, Mao Yushi, Wang Gongquan, Xiao Shu
et al, launched a “Civic Protest over the Xu Zhiyong Case"
signature movement; until the 24th morning,
400+ signatures have been collected.
The letter of protest is to call the authorities to stop
the suppression towards the “New Civic Movement".
The Letter of “Civic Protest over the Xu Zhiyong Case" states
that Xu Zhiyong is the founder of the “New Civic Movement".
The letter pointed out that 15 participants of the New Civic
Movement were formally arrested before Xu’s detention.
The letter of protest stated that this is a serious event.
From its long history, it’s the prolonging of Stalin’s
so-called dictatorship of the proletariat.
Recently, it was prolonging of rigid maintaining stability.
Now Xi’s promise of full implementation of the
constitution was openly abandoned.
The New Civic Movement is promoting the establishment
of civilization of China in a moderate and rational manner.
Xu Zhiyong and his partners actions is acting out
Article 35 of the constitution, which is completely legal;
The suppression is a violation against the constitution.
Last November, Xu Zhiyong published an open letter to
the Chinese Communist leaders Xi Jinping, titled,
“A citizen’s thinking for the nation’s future".
The letter criticizes the communist regime’s suppression
of its people in the name of “maintaining stability".
On 16th July, after three months under illegal house arrest,
Xu was formally arrested by the Beijing police for
“gathering crowds to disturb public order".
Xu’s lawyer Liu Weiguo: “Because they (the Chinese Regime)
have denied me access to meet Xu, so after I came back
from Beijing on Friday (July 19), I did not return there.
I will file a series of complaints in the coming few days."
On the 19th, the Party mouthpiece “People’s Daily",
published an article of Tsinghua scholar Hu Angaing –
“Why does peoples’society do better than civil society",
caused many critics from Internet users and Chinese scholars.
Founder of “non-violence disobedience", Tang Jingling:
“The authorities might have planned to do so,
if they can win a little in public opinion,
they would fight as much as possible;
if not, then they would have other tactics.
As of today, Chinese citizens have the power to grow in
a certain circumstance, the authorities have diverse tricks."
China civil rights lawyers Teng Biao, pointed out in
his article – “Chinese New Citizen Movement",
that China is still not able to get out the tyranny,
monopoly power, rampant corruption, inequality,
violence, demolitions, educational imbalance and
the hole of social security etc.
A series of major social problems are the root of tyranny,
the Chinese need a tide of history — great citizen movement.
Tang Jingling: “The authorities are panicking by the public’s
conscience, uncooperative and non-violent protests which
can bring the country democracy, freedom and
human rights protection, thus the CCP intended to
confuse people theoretically."
Tang Jingling said that the CCP is now panicking over citizens
helping each other, thus the CCP persists to crackdown on
the democracy protests on the street.
Tang Jingling:"Regarding the authorities’suppression
on New Citizens’Movement,
I believe the citizens who have participated and potential
to participate will become more persistent.
They will have further understandings
of the concept and movements.
In addition, they will actively take part.
I think their struggle for freedom
won’t be stopped by suppression.
Their values can not disappear, on the contrary,
it will increase after being sent to prison."
Teng Biao said that citizens are not vulgar people,
they are masters of the country.
The leader must be elected by citizens.
China should forever abandon the brutal theory
of “gun controls the country".
